1. Binding Nature of Legal Fees
All fees paid to Sunkiya “Legal” constitute acknowledgment that:
✓ Legal services commence immediately upon payment (even if court dates are later).
✓ The complexity of criminal defence makes outcomes inherently unpredictable.
2.Strict No-Refund Scenarios
Fees are non-refundable in these circumstances:
– After case strategy discussion (deemed “substantial work commencement”).
– If the client provides incomplete/false information affecting the case.
– For statutory payments already made (court fees, process server charges).
3.Limited Refund Eligibility
Partial refunds may be considered if:
– Requested within 48 hours of payment AND
– No attorney has reviewed case details (including free preliminary assessments).
Calculation:
_Refund Amount = Total Fee Paid – (₹5,000 Administrative Charge + Actual Hours Spent × Hourly Rate)_
4. Process for Refund Requests
Email: refunds@sunkiya.com within stipulated timelines with:
– Payment receipt
– Case ID
– Reason Citing Section 3 eligibility
- Decision within 10 working days.
- Force Majeure Clause
No refunds for delays/cancellations due to:
– Court strikes
– Client unavailability (e.g., missed hearings)
– Government lockdowns
6.Digital Products Policy
– Downloaded templates/guides: No returns after delivery.
– Subscription services: Cancel anytime; no prorated refunds.
7. Dispute Resolution
Unresolved disputes shall be referred to:
Delhi International Arbitration Centre under the Arbitration and Conciliation Act, 1996.
